The Honorable Joseph Dawson, III ruled today that the Plaintiffs failed to meet the elements allowing the case to go to jury.

After 5 days of deliberations in Federal Court,  The Honorable Joseph Dawson, III ruled that the Plaintiffs failed to meet the elements of proving a conspiracy, which would have allowed the case to go to a jury for a decision.

Lawyers for the Plaintiffs in the Myrtle Beach Superblock trial between the plaintiffs Danny Group, LLC, Blazian Promotions & Company, LLC, and Hector Melendez were surprised by his ruling.

The same motion to dismiss was requested by the defendant, City of Myrtle Beach, at the onset of the trial. The judge ruled Monday, March 20th against the city, allowing the jury to hear all of the evidence presented.

Today, Judge Dawson thanked the jury and sent them home.

The Plaintiffs’ attorney, Tucker Play, told MyrtleBeachSC News that he would be filing an appeal.

As of this publication, no public statements have been made by Defendant Attorney, Mike Battle, on the Myrtle Beach Superblock trial decision.
