New Golf Carts ordinance passes in North Myrtle Beach

North Myrtle Beach city officials have passed a regulation detailing fresh guidelines for golf carts operating within the city boundaries.

In a Monday afternoon meeting, the city council unanimously endorsed the new regulations, which are now in effect.

The majority of the city’s regulations align with state statutes.

Effective immediately as of May 22, 2025, a new law in South Carolina has been implemented to modify regulations regarding the operation of golf carts, including rentals. The main revisions consist of mandating seatbelts for passengers under 12 years old, allowing local authorities to establish particular guidelines for golf cart usage (such as operating at night with appropriate lighting and on specified routes), and stipulating that drivers must be minimum 16 years of age with a valid driver’s license.

Key Changes in the New Golf Carts Law:

  • Seatbelts for Children: All golf cart passengers under 12 must wear a fastened seatbelt when on public roads. 
  • Local Ordinances: Local governments (cities and counties) can now establish their own ordinances regarding golf cart operation, including where and when they can be driven. 
  • Nighttime Operation (with local ordinances): If a local ordinance is in place, golf carts can be permitted to operate at night, provided they have working headlights and taillights. 
  • Designated Golf Cart Paths: Local governments can also create designated golf cart paths, potentially separated from traffic lanes. 
  • Statewide Restrictions (in the absence of local ordinances): In areas without local ordinances, the following restrictions apply:
    • Daylight hours only. 
    • Limited to roads with a speed limit of 35 mph or less
    • Within four miles of the registered address or gated community entrance. 
  • Driver Requirements: All golf cart drivers must be at least 16 years old and possess a valid driver’s license. 
  • Registration and Insurance: Golf carts must be registered with the SCDMV, and drivers must carry proof of registration and insurance. 

Implications for Golf Cart Rentals:

  • Increased Safety: The seatbelt requirement for young children enhances safety for renters. 
  • Local Flexibility: Rental companies need to be aware of any specific local ordinances that might impact their operations in different areas. 
  • Compliance: Rental companies must ensure they comply with all state and local regulations, including providing properly equipped golf carts (with seatbelts for young children) and ensuring drivers meet the age and licensing requirements. 
  • Potential for Expansion: The ability for local governments to create ordinances may lead to increased opportunities for nighttime rentals in some areas. 

The city ordinance now permits golf cart riders to operate their vehicles between sunrise and sunset following recent amendments.

Rental shops and owners of personal golf carts have 45 days, starting from June 23, to comply before citations are issued by the city during a grace period.

Violations will incur a citation cost of $100 and/or a maximum of 30 days in city jail per violation.
