Issue at point is the current Sherman Anti-Trust Act Federal lawsuit being defended by the City of North Myrtle Beach. Cherry Grove Beach Gear filed suit against the city.

The lawsuit accuses the city of creating a government sponsored monopoly.

The City of North Myrtle Beach deliberately chose to go into the beach gear rental business, even though it is unclear if state law allows the city to do so.

Meanwhile, Cherry Grove Beach Gear is being fined daily for operating a legal business on the state-owned beaches that are located in front of the incorporated City of North Myrtle Beach.

The beach gear rental business generates $3 million annually for the City of North Myrtle Beach.
